Attorneys file class action complaint against TALX UCM Services, Inc. over improper retention of attorneys’ fees
The Lakin Law Firm, P.C. filed a class action case in St. Louis County Circuit Court, on behalf of St. Louis Law Firm Boggs Avellino Lach & Boggs, LLC and other attorney firms across the nation, against TALX UCM Services, Inc. over the improper retention of attorneys' fees.
TALX UCM Services, Inc. provides unemployment compensation services, including unemployment cost management, appellate and hearing services, and employer tax services. On behalf of its clients, TALX hired attorneys to represent its business clients with legal issues related to unemployment cases.
Boggs Avellino Lach & Boggs, LLC contends that TALX charged and collected legal fees from its clients but retained a portion of the legal fees it collected. TALX never disclosed to the Plaintiffs or class members its scheme to retain any attorneys' fees.
Lakin Law Firm Attorney Rob Schmieder pointed out that TALX's scheme is troublesome. "TALX is not a law firm consisting of licensed attorneys and, therefore, is not authorized to practice law. In addition, it is against public policy for a non-lawyer to retain or share attorneys' fees in every single State. Our client never consented to TALX keeping any portion of the attorneys' fees collected by TALX for their work. It is certainly troubling that any company would attempt to do so."
