What is the purpose of the Illinois Worker's Compensation Act?
The statute does away with your right to bring a civil action against your employer. It is often referred to as a "no-fault system" - meaning you don't have to prove fault in order to receive benefits. This is much different from a civil action where you must prove fault before you are entitled to receive even $1. This law was basically a compromise between employers and employees. The compromise - employees damages are limited but in exchange employees are not required to prove fault.
